everybody should support this guy!

Apparently all is not kosher in corn country. BMW of Lincoln, Nebraska posted an auction on eBay for a brand new M3 Sedan for $60,000. Perhaps they were hoping for the kind of eBay madness that would push the price to six figures (something other dealers are doing right on the show floor). If that's what they were after, well, they didn't get it. The car was won by a gentleman in California for the listed price: $60,000. The problem is that the dealer doesn't want to give him the car. Not long after the auction ended, the winning bidder got a call from BMW of Nebraska telling him the auction was "a mistake," and that he couldn't have the car. In spite of the fact that the dealership changed the Buy It Now price twice -- and so was paying attention to the auction -- and eBay rules that make it clear that if someone wins the auction then you must complete the transaction, the buyer is still trying to get someone to give him the car he won at the winning bid price. get a lawyer and take him to small claims

Sure ebay has millions behind their legal team, but if he truly is within THEIR own policy he has a slam dunk case.

And as much as I use eBay for selling a lot of stuff and buying a lot of stuff on evilBay, in many ways I do think it sucks.

Meh, the only reason why I like eBay is the potential for lower prices. Most of the time when I buy something there, its when a well-known product is more expensive than eBay everywhere else, or there's no other way to find it (very seldom). I hate paying for shipping and hassle of shipping things to others

craigslist is easy to use and free. A lot of used stuff, but it is much easier to make a deal, take delivery, etc. Its not for everyone either but its definitely worked for me

This also reinforces my belief that most dealerships are pricks. They can go shove their marked-up prices up their collective asses... I will buy used from a private owner.

I don't know how it works in various states, but in NY you can't take a corporation to small claims court, small claims court also can't be over something over $1000, or there abouts.

If the ebay seller has a clause in their ad that the car is for sale on their lot and may not be available they will probably get an easy out.

Bottom line is no one has been screwed, they just weren't able to secure a great deal, hardly the end of the world.

Cmon dude. He got screwed. Maybe not in a legal sense...but when you win an auction, you win. period. The dealer took a gamble and lost. Time to pay up. It was most likely the internet manager and/or sales manager who did this under the GMs nose. And if he were to find out they would most likely be fired. Tough shit.

it may not be a big hassle over the price, but its the principle of it. the dealership was yelling it was a honest mistake, but they had the auction listed as "cheapest m3 on ebay" and NO RESERVE. you win some you lose some, the dealership should stick to their word since it was a binding contract.

People should place ridiculous bids on the dealers other auctions, then call up the dealer when the auction(s) end and say that their winning bid price was a mistake and that they won't be able to honor the deal. Let's see what the dealer says/thinks about that?

Damn a$$holes.

Just finished reading through that whole thread.

Kinda like a bait and switch, no? The guy wins M3 for $60K. Seller says it was a mistake and offers car for $65,600 instead.

Oh and I read about this earlier today, it's getting lots of attention, hopefully this puts pressure on the dealership to make things right.

I would wait till they re-auction the car (or any other car), then bid some ridiculus price and when I win, I would tell them that my bid was a mistake.

I've never used ebay, but I guess I feel that if I hadn't been screwed I would be happy, regardless if the transaction was complete.

I thought I read that ebay has rules for this? Selling high $ items below market value. To combat the selling of stolen items on Ebay cheap.

It's ridiculous that they can get away with this. According to the feedback, they did this to another guy. From the way this is heading it looks like they would have been better off giving the guy the deal.

So do you think this bad publicity has cost that dealership more than $5,000 in sales by now?

I hope the original buyer gets the car for less from another BMW dealer that will capitalize on the publicity against BMW of Lincoln.

The auction started at 60,000 and had a BUY IT NOW for 66926
For $7K, they could have avoided the whole mess... They could probably make the 7K back on a couple of car sales...

Sorry its taken so long to post a update. The site is very slow (understandably). This morning, BMW of Lincoln has agreed to sell me the car at a price of 60K, with certain conditions. I'll be going over the conditions with the dealership tommorow, and I hope to have everything finalized by tommorow afternoon.

But one thing that I would like to make everyone aware of is, BMW of Lincoln is proactively working to correct the situation that they screwed up. And yes, they screwed up big time, no doubt about that.They are trying to do right, so please don't harass the dealership right now. No phone calls, threats, emails or fake sales calls.

That said, I would just like to take a step back for a moment.
The past few days have been insane. Just thinking about what has transpired, leaves you speechless really. How did this thing go from a M3post.com rant to what it became today? In 3 days, the site amassed
650+ comments and 200,000 page views, with people posting from all around the world, lending their support and help. Thats people I dont even know! Amazing stuff, and probably the coolest thing I have ever
been part of, leveraging the internet in a way that I have never seen before. People I have never met, making calls on my behalf, contacting automotive sites, supplying information, just doing anything and everything possible to help out.

Lets do it again sometime, I hope to be there for someone when they are in need.

Thanks guys, there are good people in this world after all.
I'll post again tommorow.
