everybody should support this guy!
Apparently all is not kosher in corn country. BMW of Lincoln, Nebraska posted an auction on eBay for a brand new M3 Sedan for $60,000. Perhaps they were hoping for the kind of eBay madness that would push the price to six figures (something other dealers are doing right on the show floor). If that's what they were after, well, they didn't get it. The car was won by a gentleman in California for the listed price: $60,000. The problem is that the dealer doesn't want to give him the car. Not long after the auction ended, the winning bidder got a call from BMW of Nebraska telling him the auction was "a mistake," and that he couldn't have the car. In spite of the fact that the dealership changed the Buy It Now price twice -- and so was paying attention to the auction -- and eBay rules that make it clear that if someone wins the auction then you must complete the transaction, the buyer is still trying to get someone to give him the car he won at the winning bid price. get a lawyer and take him to small claims 
Sure ebay has millions behind their legal team, but if he truly is within THEIR own policy he has a slam dunk case.
And as much as I use eBay for selling a lot of stuff and buying a lot of stuff on evilBay, in many ways I do think it sucks.

Meh, the only reason why I like eBay is the potential for lower prices. Most of the time when I buy something there, its when a well-known product is more expensive than eBay everywhere else, or there's no other way to find it (very seldom). I hate paying for shipping and hassle of shipping things to others
craigslist is easy to use and free. A lot of used stuff, but it is much easier to make a deal, take delivery, etc. Its not for everyone either but its definitely worked for me

If the ebay seller has a clause in their ad that the car is for sale on their lot and may not be available they will probably get an easy out.
Bottom line is no one has been screwed, they just weren't able to secure a great deal, hardly the end of the world.

Cmon dude. He got screwed. Maybe not in a legal sense...but when you win an auction, you win. period. The dealer took a gamble and lost. Time to pay up. It was most likely the internet manager and/or sales manager who did this under the GMs nose. And if he were to find out they would most likely be fired. Tough shit.

People should place ridiculous bids on the dealers other auctions, then call up the dealer when the auction(s) end and say that their winning bid price was a mistake and that they won't be able to honor the deal. Let's see what the dealer says/thinks about that?

Kinda like a bait and switch, no? The guy wins M3 for $60K. Seller says it was a mistake and offers car for $65,600 instead.

I would wait till they re-auction the car (or any other car), then bid some ridiculus price and when I win, I would tell them that my bid was a mistake.

It's ridiculous that they can get away with this. According to the feedback, they did this to another guy. From the way this is heading it looks like they would have been better off giving the guy the deal.

So do you think this bad publicity has cost that dealership more than $5,000 in sales by now? 
I hope the original buyer gets the car for less from another BMW dealer that will capitalize on the publicity against BMW of Lincoln.

But one thing that I would like to make everyone aware of is, BMW of Lincoln is proactively working to correct the situation that they screwed up. And yes, they screwed up big time, no doubt about that.They are trying to do right, so please don't harass the dealership right now. No phone calls, threats, emails or fake sales calls.
That said, I would just like to take a step back for a moment.
